US Sets 0.74% Final Duty on Indian Stainless Pressure Pipe Maker Suncity

United States sets a final 0.74% anti-dumping margin for Indian pipe maker Suncity, with new deposits from Oct. 22, 2026.

The U.S. Department of Commerce set a final 0.74% anti-dumping margin for Indian welded stainless pressure pipe maker Suncity, effective Oct. 22, 2026.

The decision closes Commerce’s yearly review of pipe that Suncity Metals and Tubes Private Limited sold to the United States between Nov. 1, 2023, and Oct. 31, 20241. The notice was published in the Federal Register on Oct. 22, 20261.

In short, new pipe shipments from Suncity now need a cash deposit of 0.74% of their value at the U.S. border. That is far below the 21.77% rate set for the same company a year earlier2.

What did Commerce decide on Indian stainless pipe?

Commerce found that Suncity sold welded stainless pressure pipe in the United States at less than normal value during the review period1. This is called dumping: selling goods abroad below their normal price at home. An anti-dumping duty is an extra import tax that makes up the difference.

The final weighted-average dumping margin for Suncity is 0.74%1. This margin is the average gap between Suncity’s normal price and its U.S. price, as a share of the U.S. price. Suncity was the only producer and exporter left in this review1.

The notice, which the Federal Register calls the final results of the 2023-2024 administrative review, is applicable from Oct. 22, 20261. It was signed on Oct. 16, 2026, by Scot Fullerton, Commerce’s acting deputy assistant secretary for anti-dumping and countervailing duty operations1.

How did the Suncity rate change from May?

In its preliminary results of May 6, 2026, Commerce had proposed a margin of 0.96% for Suncity3. It then invited companies to comment on that first finding3.

Suncity sent a case brief, a written argument against parts of the calculation1. Commerce made "certain changes" to the margin after reading it1. The final figure fell from 0.96% to 0.74%.

The appendix to the final notice lists three points Suncity raised1:

  • Double-counted costs: Suncity argued that Commerce had added general and administrative expenses and interest expenses twice.
  • Late payment fees: Suncity asked Commerce to add late payment fees to the price of its sales in India.
  • Zero-quantity sales: Suncity asked Commerce to remove home-market sales with zero quantities.

The full reasons are in a separate Issues and Decision Memorandum1. The Federal Register notice does not say which of the three points Commerce accepted. It says only that the margin changed after it studied Suncity’s comments.

How does the new rate compare with earlier reviews?

The same order has been reviewed year after year. In the previous review, covering Nov. 1, 2022, to Oct. 31, 2023, Commerce set Suncity’s final margin at 21.77%2. That notice took effect on Sept. 11, 20252.

Suncity dumping margin by review step, %

2022-2023 final 21.77%
2023-2024 preliminary 0.96%
2023-2024 final 0.74%

In that earlier review, Commerce also found that Suncity Metals and Tubes is the same business as Suncity Sheets Pvt. Ltd.2. The company had only changed its legal name. So Suncity Metals kept the same anti-dumping deposit rate and customs number as before2.

The new 0.74% rate is a drop of more than 21 percentage points from the 21.77% rate. For a U.S. buyer of Suncity pipe, the money held at the border on each shipment falls sharply.

The rate for all other producers and exporters stays at 8.35%1. Commerce set that rate in its original investigation of Indian pipe1.

Why was the rate not set at zero?

Commerce treats a margin below 0.50% as "de minimis", meaning too small to count3. When a margin is de minimis, the cash deposit rate becomes zero3. Customs then clears the goods without anti-dumping duties1.

Suncity’s final margin of 0.74% is above that 0.50% line. So the duty still applies, but at a low level. The preliminary 0.96% rate was also above the line3.

The same zero rule applies to each U.S. importer separately. If an importer’s own assessment rate is zero or de minimis, customs will clear its entries without anti-dumping duties1.

What changes for shipments from Oct. 22?

The new deposit rates cover all shipments of the pipe entered for sale in the United States on or after Oct. 22, 20261. They also cover goods taken out of a bonded warehouse for sale from that date1. A cash deposit is money the importer pays to customs as an estimate of the final duty.

Who made or exported the pipeDeposit rate
Suncity0.74%
Exporters reviewed beforeOwn most recent rate
New exporter, reviewed producerProducer’s most recent rate
All other producers and exporters8.35%

Commerce sets the deposit by who made and exported the pipe1:

  • Suncity: 0.74%, the rate from this review.
  • Exporters reviewed before: the company’s own rate from the most recent completed review or investigation.
  • New exporters with a reviewed producer: the producer’s most recent rate.
  • All other producers and exporters: 8.35%, the rate from the original investigation.

These deposit rates stay in force until Commerce gives further notice1. U.S. Customs and Border Protection (CBP), the U.S. border agency, collects the deposits.

How will duties on 2023-2024 shipments be settled?

The review also fixes the final duty on pipe that entered during the review period1. Commerce worked out a separate rate for each U.S. importer of Suncity pipe1. It divided the total dumping found on that importer’s sales by their entered value1.

Where Commerce did not have entered values for all sales to an importer, it used a rate per unit instead1. That rate is the total dumping divided by the quantity sold1.

Some Suncity pipe reached the United States through a reseller or trading company. If Suncity did not know the pipe was going to the United States, a different rule applies1. CBP will charge those entries the 8.35% all-others rate, unless the trading company has its own rate1.

Commerce plans to send these instructions to CBP no earlier than 35 days after Oct. 22, 20261. CBP will then "liquidate" the entries, which means it fixes the final duty owed on each one.

Which goods and companies does the order cover?

The goods are welded stainless pressure pipe from India1. The anti-dumping order on this pipe was published on Nov. 17, 20163. The full product description is in Commerce’s decision memorandum, not in the notice itself1.

This review began with five companies3. Commerce started it on Dec. 18, 2024, after timely requests3. It picked Jindal Saw Limited and Suncity as the two main companies to examine3.

Four companies then withdrew their requests for review, and Commerce dropped them from it3:

  • Jindal Saw Limited
  • Prakash Steelage Ltd. of India
  • Seth Steelage Pvt. Ltd.
  • Ratnamani Metals & Tubes Ltd.

For those four, the final duty on 2023-2024 entries equals the cash deposit paid when the goods entered3. Their own deposit rates from earlier proceedings stay in place1.

Why did the review take so long?

The review period ended on Oct. 31, 20241. Commerce moved its deadlines several times. It added 90 days in December 2024 and 47 days because of the federal government shutdown in late 20253. It added another 21 days for a backlog of filings after the shutdown3.

Key dates in the 2023-2024 review

18 Dec 2024 Review starts
6 May 2026 Preliminary results 0.96%
22 Oct 2026 Final results apply 0.74%

Commerce also extended the preliminary deadline by 61 days and then by 52 more days3. After the preliminary results, it extended the final deadline twice, on Aug. 19 and Oct. 2, 20261. Those two moves added 43 days in total, and the final deadline became Oct. 16, 20261.

What must importers and the company do next?

U.S. importers must file a certificate about duty refunds before customs liquidates their entries from the review period1. The certificate states whether the exporter has paid back the importer’s anti-dumping or countervailing duties1. A countervailing duty is an extra tax that offsets foreign subsidies.

Without the certificate, Commerce may presume the duties were paid back1. It could then charge double anti-dumping duties1. It could also raise the anti-dumping duty by the amount of the countervailing duty1.

Commerce will share its calculations with the parties within five days of publication1. A party may still challenge the result at the U.S. Court of International Trade. If a timely summons is filed there, CBP will hold the entries until the time to ask for a court order has run out1. That window lasts up to 90 days from publication1.
