Its new reviews ask whether Liebherr Machinery (Dalian) Co., Ltd. deserves its own duty rate<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\" id=\"hsn-cite-1\">1<\/a><\/sup>. While the reviews run, the UK government has stopped collecting both duties on this company&#8217;s excavators<sup class=\"hsn-cite\"><a href=\"#hsn-ref-2\" id=\"hsn-cite-2\">2<\/a><\/sup>.<\/p>\n<p class=\"wp-block-paragraph\">In short, an excavator made by Liebherr Dalian in China now enters the UK at a 0% trade remedy duty. The importer must enter the right company code on the customs declaration to get that rate<sup class=\"hsn-cite\"><a href=\"#hsn-ref-3\" id=\"hsn-cite-3\">3<\/a><\/sup>.<\/p>\n<h2 class=\"wp-block-heading\">What changed for Liebherr excavators on Oct. 15?<\/h2>\n<p class=\"wp-block-paragraph\">Since May 2025, the UK has charged two extra import taxes on many Chinese tracked excavators. One is an <strong>anti-dumping duty<\/strong>, an extra tax on goods sold abroad below their normal price. The other is a <strong>countervailing duty<\/strong>, an extra tax that offsets government subsidies paid to the maker.<\/p>\n<p class=\"wp-block-paragraph\">The anti-dumping duty came from Trade remedies notice 2025\/10, after the TRA&#8217;s investigation AD0047<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>. The countervailing duty came from Trade remedies notice 2025\/11<sup class=\"hsn-cite\"><a href=\"#hsn-ref-4\" id=\"hsn-cite-4\">4<\/a><\/sup>. The anti-dumping measures applied from May 14, 2025<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>. The countervailing measures also applied from that date<sup class=\"hsn-cite\"><a href=\"#hsn-ref-5\" id=\"hsn-cite-5\">5<\/a><\/sup>.<\/p>\n<p class=\"wp-block-paragraph\">On Oct. 15, 2026, the TRA started two new exporter reviews of these duties for Liebherr Dalian<sup class=\"hsn-cite\"><a href=\"#hsn-ref-3\">3<\/a><\/sup>. On the same day, the Secretary of State published two notices that suspend the duties for this company. Trade remedies notice 2026\/30 suspends the anti-dumping duty<sup class=\"hsn-cite\"><a href=\"#hsn-ref-2\">2<\/a><\/sup>. Trade remedies notice 2026\/29 suspends the countervailing duty<sup class=\"hsn-cite\"><a href=\"#hsn-ref-4\">4<\/a><\/sup>.<\/p>\n<p class=\"wp-block-paragraph\">HM Revenue &amp; Customs (HMRC), the UK customs authority, announced the change in its tariff news bulletin. It said <strong>a 0% rate of duty<\/strong> applies from Oct. 15, 2026, under additional code 8A77<sup class=\"hsn-cite\"><a href=\"#hsn-ref-3\">3<\/a><\/sup>.<\/p>\n<h2 class=\"wp-block-heading\">What is a new exporter review?<\/h2>\n<p class=\"wp-block-paragraph\">A new exporter review is a check for a foreign company that did not ship the goods during the original investigation. Such a company usually pays the high rate set for all other exporters. The review lets it ask for a rate based on its own situation.<\/p>\n<p class=\"wp-block-paragraph\">Liebherr Dalian applied for this review. The TRA&#8217;s notice of initiation says the application includes evidence that the company is not related to any exporter already paying an anti-dumping amount<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>. It also says the company did not export these excavators to the UK during the original investigation period<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>.<\/p>\n<p class=\"wp-block-paragraph\">The application also shows that Liebherr Dalian either is exporting the goods to the UK now or has a contract to export a significant quantity<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>. The TRA said it was satisfied that the legal requirements were met<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>. It found the company had given enough evidence to justify a review<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>.<\/p>\n<h2 class=\"wp-block-heading\">Which excavators are covered?<\/h2>\n<p class=\"wp-block-paragraph\">The suspension covers only one kind of machine. These are <strong>self-propelled tracked excavators<\/strong> with an upper body that turns a full 360 degrees<sup class=\"hsn-cite\"><a href=\"#hsn-ref-2\">2<\/a><\/sup>. The suspension does not change them.<\/p>\n<h2 class=\"wp-block-heading\">How does the 0% rate work at the border?<\/h2>\n<p class=\"wp-block-paragraph\">The suspension works through an <strong>additional code<\/strong>, a four-character code an importer adds to the customs declaration. It tells customs which exporter made the goods. For Liebherr Machinery (Dalian) Co., Ltd., the code is <strong>8A77<\/strong><sup class=\"hsn-cite\"><a href=\"#hsn-ref-2\">2<\/a><\/sup>.<\/p>\n<figure class=\"hsn-fig hsn-fig--solid hsn-fig--v3 hsn-fig--side\" data-at=\"how-does-the-0-rate-work-at-the-border\">\n  <div class=\"hsn-fig__flow\">\n    <h4>Clearing a Liebherr Dalian excavator<\/h4>\n    <div class=\"hsn-fig__step\">\n      <strong>Classify the machine<\/strong>\n      <span>Commodity code 8429 5210 00<\/span>\n    <\/div>\n    <div class=\"hsn-fig__step\">\n      <strong>Check the exporter<\/strong>\n      <span>Liebherr Machinery (Dalian) Co., Ltd.<\/span>\n    <\/div>\n    <div class=\"hsn-fig__step\">\n      <strong>Enter additional code 8A77<\/strong>\n      <span>On the import declaration<\/span>\n    <\/div>\n    <div class=\"hsn-fig__step\">\n      <strong>Customs applies 0%<\/strong>\n      <span>Both trade remedy duties<\/span>\n    <\/div>\n  <\/div>\n<\/figure>\n<p class=\"wp-block-paragraph\">The steps for a shipment are simple:<\/p>\n<ol>\n<li>The importer classifies the machine under commodity code 8429 5210 00.<\/li>\n<li>The importer checks that the exporter is Liebherr Machinery (Dalian) Co., Ltd.<\/li>\n<li>The importer enters additional code 8A77 on the import declaration.<\/li>\n<li>Customs applies the 0% rate to both the anti-dumping and countervailing duty<sup class=\"hsn-cite\"><a href=\"#hsn-ref-3\">3<\/a><\/sup>.<\/li>\n<\/ol>\n<p class=\"wp-block-paragraph\">The notices only stop the collection of the two trade remedy duties<sup class=\"hsn-cite\"><a href=\"#hsn-ref-2\">2<\/a><\/sup>.<\/p>\n<p class=\"wp-block-paragraph\">Other Chinese makers already have their own codes. A July 2026 notice lists codes for the Liugong, Sany, XCMG, Sunward and Caterpillar groups<sup class=\"hsn-cite\"><a href=\"#hsn-ref-6\" id=\"hsn-cite-6\">6<\/a><\/sup>. Code 8A35 covers all other exporters, which pay the residual amount<sup class=\"hsn-cite\"><a href=\"#hsn-ref-6\">6<\/a><\/sup>.<\/p>\n<h2 class=\"wp-block-heading\">How long does the suspension last?<\/h2>\n<p class=\"wp-block-paragraph\">The two notices take effect from <strong>Oct. 15, 2026<\/strong><sup class=\"hsn-cite\"><a href=\"#hsn-ref-2\">2<\/a><\/sup>. The suspension lasts until the new exporter review concludes or is terminated<sup class=\"hsn-cite\"><a href=\"#hsn-ref-4\">4<\/a><\/sup>.<\/p>\n<p class=\"wp-block-paragraph\">The end of the review will decide what Liebherr Dalian pays from then on. The TRA will recommend whether the company should be treated as a new exporter<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>. It will also say which anti-dumping amount should apply to its goods<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>.<\/p>\n<p class=\"wp-block-paragraph\">The Secretary of State then decides whether to accept, reject or ask the TRA to reassess that recommendation<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>. If the recommendation is rejected, the Secretary of State may make another decision<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>. This means the 0% rate is temporary. Liebherr Dalian&#8217;s final rate could be higher.<\/p>\n<h2 class=\"wp-block-heading\">Who else is named in the excavator review?<\/h2>\n<p class=\"wp-block-paragraph\">The TRA&#8217;s notice lists the known importers and foreign exporters of these excavators. All of them registered for the original investigation AD0047<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>. The list includes these importers:<\/p>\n<ul>\n<li><strong>Sany Heavy Machinery (UK) Ltd<\/strong><\/li>\n<li><strong>Liugong Machinery (UK) Limited<\/strong><\/li>\n<li><strong>XCMG UKSS<\/strong><\/li>\n<li><strong>Finning (UK) Limited<\/strong><\/li>\n<\/ul>\n<p class=\"wp-block-paragraph\">The overseas exporters listed include companies from the Sany, Liugong and XCMG groups. Sunward Intelligent Equipment Co., Ltd and Caterpillar (Xuzhou) Limited are also on the list<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>.<\/p>\n<p class=\"wp-block-paragraph\">These companies keep paying their own duty rates. The suspension applies only to goods from Liebherr Dalian<sup class=\"hsn-cite\"><a href=\"#hsn-ref-2\">2<\/a><\/sup>. Competing importers may still take part in the review and comment on the application.<\/p>\n<h2 class=\"wp-block-heading\">When must companies register for the review?<\/h2>\n<p class=\"wp-block-paragraph\">Anyone who wants to take part must contact the TRA by <strong>Oct. 30, 2026<\/strong><sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>. Registration is done through the TRA&#8217;s online portal. These include the government of China, foreign exporters and producers, importers and their trade groups<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>. UK makers of similar excavators and their trade groups can also take part<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>.<\/p>\n<p class=\"wp-block-paragraph\">Parties then have 31 days after registration closes to send comments. That gives a deadline of <strong>Nov. 30, 2026<\/strong> for submissions<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>. Parties may also ask for a hearing<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>.<\/p>\n<p class=\"wp-block-paragraph\">The TRA said it does not plan to publish a Statement of Essential Facts in this review<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>. After the comment period, the next main step is the TRA&#8217;s recommendation to the Secretary of State<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>.<\/p>\n<h2 class=\"wp-block-heading\">What period does the review examine?<\/h2>\n<p class=\"wp-block-paragraph\">The review looks at the same period as the original case: <strong>July 1, 2022, to June 30, 2023<\/strong><sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>. During the review, the TRA will check whether Liebherr Dalian is linked to any exporter already paying duty<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>.<\/p>\n<p class=\"wp-block-paragraph\">It will also check whether the company shipped these excavators to the UK in that period<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>. A company that shipped then, or is linked to a company that did, would not count as a new exporter. The TRA will then set the duty it thinks should apply.<\/p>\n<h2 class=\"wp-block-heading\">How does this fit with earlier excavator decisions?<\/h2>\n<p class=\"wp-block-paragraph\">This is not the first new exporter review of these duties. In November 2025, another notice suspended the anti-dumping duty during an earlier new exporter review<sup class=\"hsn-cite\"><a href=\"#hsn-ref-7\" id=\"hsn-cite-7\">7<\/a><\/sup>. A separate review for Zoomlion Heavy Industry Science &amp; Technology Co., Ltd was terminated on July 13, 2026<sup class=\"hsn-cite\"><a href=\"#hsn-ref-5\">5<\/a><\/sup>. Zoomlion had withdrawn its application<sup class=\"hsn-cite\"><a href=\"#hsn-ref-5\">5<\/a><\/sup>.<\/p>\n<p class=\"wp-block-paragraph\">The excavator duties are also under a separate absorption review, started on March 30, 2026<sup class=\"hsn-cite\"><a href=\"#hsn-ref-6\">6<\/a><\/sup>. That review checks whether exporters are absorbing the duty instead of raising their prices. Since July 16, 2026, HMRC has registered imports of these excavators for that review<sup class=\"hsn-cite\"><a href=\"#hsn-ref-6\">6<\/a><\/sup>.<\/p>\n<p class=\"wp-block-paragraph\">The new Liebherr suspension does not end those other steps.
