A surtax is an extra tax that customs collects on top of normal import duty.<\/p>\n<p class=\"wp-block-paragraph\">In short, many U.S. goods now cost more to bring into Canada. The Canadian importer pays the surtax at the border, and the rate depends on the product.<\/p>\n<h2 class=\"wp-block-heading\">Why did Canada tax U.S. goods from Sept. 8?<\/h2>\n<p class=\"wp-block-paragraph\">On Aug. 22, 2026, the United States put tariffs of 50% on a range of goods from Canada<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>. It used Section 338 of its Tariff Act of 1930 and said Canada treated U.S. cars, alcohol and dairy unfairly<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>. Canada rejects that claim and says its trade practices are fair.<\/p>\n<figure class=\"hsn-fig hsn-fig--solid hsn-fig--v4 hsn-fig--rail\" data-at=\"why-did-canada-tax-u-s-goods-from-sept-8\">\n  <div class=\"hsn-fig__flow\">\n    <h4>How the two sides got here<\/h4>\n    <div class=\"hsn-fig__step\" data-series=\"1\">\n      <strong>50% tariffs on Canadian goods<\/strong>\n      <span>Aug. 22, 2026, under Section 338<\/span>\n    <\/div>\n    <div class=\"hsn-fig__step\" data-series=\"2\">\n      <strong>Surtax of 15%, 25% or 50%<\/strong>\n      <span>On U.S. goods from Sept. 8, 2026<\/span>\n    <\/div>\n    <div class=\"hsn-fig__step\" data-series=\"1\">\n      <strong>Tariffs changed, bans announced<\/strong>\n      <span>From Sept. 15 and Sept. 29, 2026<\/span>\n    <\/div>\n  <\/div>\n  <div class=\"hsn-fig__key\">\n    <span class=\"hsn-fig__keyitem\" data-series=\"1\">United States<\/span>\n    <span class=\"hsn-fig__keyitem\" data-series=\"2\">Canada<\/span>\n  <\/div>\n<\/figure>\n<p class=\"wp-block-paragraph\">On Aug. 25, 2026, Finance Minister Fran\u00e7ois-Philippe Champagne said Canada would match the U.S. tariffs &quot;dollar for dollar, rate for rate&quot;<sup class=\"hsn-cite\"><a href=\"#hsn-ref-2\" id=\"hsn-cite-2\">2<\/a><\/sup>. The Canadian tax focuses on sectors such as steel, dairy, appliances, farm equipment, pulp and paper, and electronics<sup class=\"hsn-cite\"><a href=\"#hsn-ref-2\">2<\/a><\/sup>.<\/p>\n<p class=\"wp-block-paragraph\">Canada chose products that the U.S. hit with its Section 338 tariffs and its Section 232 tariffs<sup class=\"hsn-cite\"><a href=\"#hsn-ref-3\" id=\"hsn-cite-3\">3<\/a><\/sup>. For each product, the Canadian rate generally matches the U.S. rate on the same goods<sup class=\"hsn-cite\"><a href=\"#hsn-ref-3\">3<\/a><\/sup>. The Department of Finance says the goal is to help Canadian producers compete with U.S. products at home<sup class=\"hsn-cite\"><a href=\"#hsn-ref-2\">2<\/a><\/sup>.<\/p>\n<h2 class=\"wp-block-heading\">Which U.S. goods pay 15%, 25% or 50%?<\/h2>\n<p class=\"wp-block-paragraph\">The order puts each product code in one of three lists, called schedules<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>. Costs for transport after the goods start their direct journey to Canada are left out of this value<sup class=\"hsn-cite\"><a href=\"#hsn-ref-3\">3<\/a><\/sup>.<\/p>\n<p class=\"wp-block-paragraph\">The 15% list is short and covers machinery items, such as forklift trucks and parts of air conditioners (codes 8427 and 8415)<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>. The 25% list includes many kinds of cheese, such as cheddar, brie, gouda and mozzarella<sup class=\"hsn-cite\"><a href=\"#hsn-ref-4\" id=\"hsn-cite-4\">4<\/a><\/sup>. It also includes appliances and some steel and aluminum products<sup class=\"hsn-cite\"><a href=\"#hsn-ref-2\">2<\/a><\/sup>.<\/p>\n<p class=\"wp-block-paragraph\">The 50% list includes milk powder, whey, natural honey and sugar molasses<sup class=\"hsn-cite\"><a href=\"#hsn-ref-4\">4<\/a><\/sup>. The Finance department says it also covers furniture, clothing and some steel and aluminum products<sup class=\"hsn-cite\"><a href=\"#hsn-ref-2\">2<\/a><\/sup>. Those metal goods previously faced a 25% Canadian counter-tariff<sup class=\"hsn-cite\"><a href=\"#hsn-ref-2\">2<\/a><\/sup>.<\/p>\n<h2 class=\"wp-block-heading\">How does CBSA collect the surtax on U.S. goods?<\/h2>\n<p class=\"wp-block-paragraph\">The Canada Border Services Agency (CBSA), which runs Canada&#8217;s borders, collects the surtax<sup class=\"hsn-cite\"><a href=\"#hsn-ref-3\">3<\/a><\/sup>. It explained the rules in Customs Notice 26-23, dated Sept. 7, 2026<sup class=\"hsn-cite\"><a href=\"#hsn-ref-3\">3<\/a><\/sup>. A good has a value for duty of $150, no normal duty, and a 25% surtax<sup class=\"hsn-cite\"><a href=\"#hsn-ref-3\">3<\/a><\/sup>. The surtax is $37.50, and the 5% GST is then charged on $187.50<sup class=\"hsn-cite\"><a href=\"#hsn-ref-3\">3<\/a><\/sup>.<\/p>\n<p class=\"wp-block-paragraph\">That point matters for costs. The GST, Canada&#8217;s federal sales tax, is charged on a value that includes the surtax<sup class=\"hsn-cite\"><a href=\"#hsn-ref-3\">3<\/a><\/sup>. So the real extra cost is a little higher than the surtax rate alone.<\/p>\n<p class=\"wp-block-paragraph\">The surtax also applies to small parcels. It applies to shipments under the low-value &quot;de minimis&quot; limits and to goods sent by post or courier<sup class=\"hsn-cite\"><a href=\"#hsn-ref-3\">3<\/a><\/sup>. It covers both business imports and personal purchases<sup class=\"hsn-cite\"><a href=\"#hsn-ref-3\">3<\/a><\/sup>.<\/p>\n<h2 class=\"wp-block-heading\">Which goods count as made in the United States?<\/h2>\n<p class=\"wp-block-paragraph\">The surtax applies only to goods that originate in the United States<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>. A good counts as U.S. if it can be marked as a product of the United States under Canada&#8217;s marking rules for CUSMA countries<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>. CUSMA is the trade agreement between Canada, the United States and Mexico.<\/p>\n<p class=\"wp-block-paragraph\">Where the goods ship from does not matter. The surtax applies even when U.S. goods reach Canada from a third country<sup class=\"hsn-cite\"><a href=\"#hsn-ref-3\">3<\/a><\/sup>. Goods marked as from Puerto Rico, Guam, the Northern Mariana Islands, American Samoa or the U.S. Virgin Islands do not pay<sup class=\"hsn-cite\"><a href=\"#hsn-ref-3\">3<\/a><\/sup>.<\/p>\n<p class=\"wp-block-paragraph\">For business shipments, importers must show where the goods come from. A commercial invoice can serve as <strong>proof of origin<\/strong> if it has the minimum details listed in CUSMA<sup class=\"hsn-cite\"><a href=\"#hsn-ref-3\">3<\/a><\/sup>. For personal goods, a &quot;made in the U.S.&quot; mark is enough to make them U.S. goods<sup class=\"hsn-cite\"><a href=\"#hsn-ref-3\">3<\/a><\/sup>.<\/p>\n<h2 class=\"wp-block-heading\">Which shipments escape the new Canadian surtax?<\/h2>\n<p class=\"wp-block-paragraph\">The order lists several exceptions<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>. The surtax does not apply to:<\/p>\n<ul>\n<li>goods in transit to Canada on Sept. 8, 2026<\/li>\n<li>most goods under Chapters 98 and 99, the special customs codes<\/li>\n<li>personal goods of Campobello Island residents back within 24 hours<\/li>\n<li>goods with an Import for Re-Export Program permit<\/li>\n<\/ul>\n<figure class=\"hsn-fig hsn-fig--solid hsn-fig--v4 hsn-fig--grid2\" data-at=\"which-shipments-escape-the-new-canadian-surtax\">\n  <div class=\"hsn-fig__cards\">\n    <h4>What escapes the surtax<\/h4>\n    <div class=\"hsn-fig__card\" data-series=\"1\">\n      <strong>Goods in transit on Sept. 8, 2026<\/strong>\n      <span>With proof such as a bill of lading<\/span>\n    <\/div>\n    <div class=\"hsn-fig__card\" data-series=\"1\">\n      <strong>Most Chapter 98 and 99 goods<\/strong>\n      <span>The special customs codes<\/span>\n    <\/div>\n    <div class=\"hsn-fig__card\" data-series=\"1\">\n      <strong>Import for Re-Export Program goods<\/strong>\n      <span>When they have a permit<\/span>\n    <\/div>\n    <div class=\"hsn-fig__card\" data-series=\"1\">\n      <strong>Steel derivative goods<\/strong>\n      <span>Pay only this order&#8217;s surtax, not both<\/span>\n    <\/div>\n  <\/div>\n<\/figure>\n<p class=\"wp-block-paragraph\">Goods in transit must be on their way and in a carrier&#8217;s hands<sup class=\"hsn-cite\"><a href=\"#hsn-ref-3\">3<\/a><\/sup>. Importers need <strong>proof of transit<\/strong>, such as a bill of lading, cargo control papers or entry reports<sup class=\"hsn-cite\"><a href=\"#hsn-ref-3\">3<\/a><\/sup>. A CBSA officer may ask for this proof at any time<sup class=\"hsn-cite\"><a href=\"#hsn-ref-3\">3<\/a><\/sup>.<\/p>\n<p class=\"wp-block-paragraph\">Some goods do not pay twice. If a good falls under both this order and the Steel Derivative Goods Surtax Order, only this order&#8217;s surtax applies<sup class=\"hsn-cite\"><a href=\"#hsn-ref-3\">3<\/a><\/sup>. The surtax is also cancelled for goods covered by the Akwesasne Residents Remission Order<sup class=\"hsn-cite\"><a href=\"#hsn-ref-3\">3<\/a><\/sup>.<\/p>\n<h2 class=\"wp-block-heading\">Can importers get U.S. surtax money back?<\/h2>\n<p class=\"wp-block-paragraph\">Some importers can. Canada&#8217;s Duties Relief and Duty Drawback programs cover the surtax<sup class=\"hsn-cite\"><a href=\"#hsn-ref-3\">3<\/a><\/sup>. These programs let firms skip or recover duty on goods they later export<sup class=\"hsn-cite\"><a href=\"#hsn-ref-5\" id=\"hsn-cite-5\">5<\/a><\/sup>.<\/p>\n<p class=\"wp-block-paragraph\">The order also widens an existing refund rule, the United States Surtax Remission Order (2025)<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>. It now refunds this surtax on some goods used for health care, public safety and national defence<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>. It also refunds it on goods used in Canada to make products, grow farm goods or package food and drinks<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>.<\/p>\n<p class=\"wp-block-paragraph\">The Finance department says Canada&#8217;s other counter-tariffs, including those on U.S. cars, stay in place<sup class=\"hsn-cite\"><a href=\"#hsn-ref-2\">2<\/a><\/sup>. Importers can email the department about a remission request with <strong>&quot;U.S. Remission&quot;<\/strong> in the subject line<sup class=\"hsn-cite\"><a href=\"#hsn-ref-5\">5<\/a><\/sup>.<\/p>\n<p class=\"wp-block-paragraph\">The U.S. side has already moved again. It changed its Section 338 tariffs from Sept. 15 and announced import bans on some Canadian products from <strong>Sept. 29, 2026<\/strong><sup class=\"hsn-cite\"><a href=\"#hsn-ref-5\">5<\/a><\/sup>. Canada&#8217;s 15%, 25% and 50% rates stay on U.S. goods at the border under the order<sup class=\"hsn-cite\"><a href=\"#hsn-ref-1\">1<\/a><\/sup>.<\/p>\n<h2 class=\"wp-block-heading
